These Terms & Conditions (“Terms”) govern your access to and use of the websites, hardware products, software, and services provided by Antimattr Private Limited (“antimattr,” “we,” “us,” or “our”), including AI earbuds, companion applications, accessories, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 18 years old to use the Services.

By using the Services, you confirm that:

you are legally capable of entering into a binding contract under Indian law, and

you will comply with all applicable laws and regulations.

Account and device responsibility

Certain features require creating an account.

You agree to:

provide accurate and up-to-date information,

keep your login credentials secure, and

notify us immediately of unauthorized access.

You are responsible for all activity conducted through your account and devices.

Product descriptions and availability

We aim to provide accurate product descriptions. However:

features and specifications may evolve during development,

visuals may differ from final shipped products, and

availability may change without notice.

We reserve the right to modify or discontinue products at any time.

Pre-orders and refunds

When you place a pre-order or reservation:

you are reserving a product expected to ship in the future,

estimated delivery timelines are indicative and not guaranteed.

Refund policy

Pre-orders are fully refundable before shipment.

Refunds will be processed to the original payment method within a reasonable timeframe, subject to payment provider processing times.

After shipment, returns are governed by our return and warranty policy.

Payments

Payments are processed through secure third-party payment providers.

You agree to:

provide valid payment information,

authorize charges for the listed price and applicable taxes,

pay shipping and related fees.

We are not responsible for payment processor errors or service interruptions.

Shipping and delivery

Delivery estimates are approximate.

We are not liable for delays caused by:

logistics providers,

customs or regulatory processes,

force majeure events, or

events beyond our reasonable control.

Risk of loss transfers to you upon delivery.

Warranty (1-year limited hardware warranty)

Antimattr provides a 1-year limited warranty on hardware products from the date of delivery.

This warranty covers:

manufacturing defects, and

hardware malfunctions under normal use.

This warranty does not cover:

accidental damage, misuse, or unauthorized modification,

cosmetic wear and tear,

damage caused by external factors or improper handling.

AI and software features are provided as-is and may evolve over time. We do not guarantee uninterrupted or error-free operation.

Acceptable use

You agree not to use the Services to:

violate any applicable laws,

infringe intellectual property rights,

record others unlawfully,

harass or harm others,

attempt to reverse engineer or compromise the system.

You are responsible for using voice-enabled features lawfully and ethically, including obtaining consent where required.

AI and voice disclaimer

The Services include AI-powered features that may:

produce inaccurate or incomplete outputs,

misinterpret speech, or

behave unpredictably.

AI outputs are assistance tools and not professional advice. You are responsible for verifying important information.

Privacy

Your use of the Services is governed by our Privacy Policy.

By using the Services, you consent to data handling described there.

Intellectual property

All intellectual property in the Services belongs to Antimattr.

You receive a limited, non-exclusive license for personal use.

You may not copy, distribute, or modify proprietary technology without permission.

Software updates

We may provide software updates that:

improve performance,

add or remove features,

enhance security.

Some updates may be required to continue using the Services.

Third-party services

The Services may integrate with third-party platforms.

We are not responsible for third-party content or services.

Your use of those services is governed by their terms.

Limitation of liability

To the maximum extent permitted by Indian law:

Antimattr is not liable for indirect or consequential damages, including loss of profits or data.

Our total liability shall not exceed the amount you paid for the relevant product or service.

Nothing in these Terms excludes liability that cannot legally be excluded.

Indemnification

You agree to indemnify Antimattr against claims arising from:

misuse of the Services,

violation of these Terms, or

infringement of third-party rights.

Termination

We may suspend or terminate access if you violate these Terms.

You may stop using the Services at any time.

Certain provisions survive termination.

Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, internet outages, or government actions.

Dispute resolution and arbitration (India)

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Seat of arbitration: Bangalore, India

Arbitration shall be conducted in English

A single arbitrator shall be appointed mutually

Courts in Bangalore shall have jurisdiction over matters not subject to arbitration.

Governing law

These Terms are governed by the laws of India.

Changes to Terms

We may update these Terms periodically.

Continued use after updates constitutes acceptance.
